These Terms & Conditions ("Terms") govern your access to and use of the Pitstop platform, including our website, mobile applications, AI sales coaching tools, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

DEFINITIONS
The following definitions apply to these Terms. Some definitions may apply to future Services features.
1. THE SERVICES
Pitstop provides AI-powered sales coaching tools designed to analyze recorded sales conversations, support pre-call preparation, and reinforce best-practice sales execution standards. The Services generate feedback, insights, benchmarks, and recommendations based on user-provided inputs.
The Services are provided for informational and developmental purposes only. Pitstop does not guarantee sales outcomes, revenue performance, or deal success.
The Services may include AI-powered avatars or personas that deliver feedback, guidance, or coaching-style interactions as part of the sales execution experience.
Avatars may include:
- Fully synthetic AI personas
- AI personas trained on the methods, frameworks, or coaching approaches of real human sales coaches, with appropriate rights and permissions
- Custom AI personas configured by organizations to reflect internal goals, methodologies, or execution standards
The Services may expand over time to include coaching for other business execution workflows.
Where an avatar is trained on the methods or approaches of a real human coach, the avatar does not represent that individual personally and does not reproduce the individual's identity, voice, likeness, or personal judgment. Avatars do not act as agents, representatives, or substitutes for any human coach.
All avatars operate as automated systems and do not provide licensed professional advice. Use of avatars does not create a personal coaching, employment, fiduciary, or advisory relationship.
All avatar responses are generated algorithmically and are subject to the same limitations, disclaimers, and user responsibility as other Outputs. Responses may not reflect real-world judgment, context, or situational nuance.
2. ELIGIBILITY AND ACCOUNT USE
You must be at least 18 years old and have the legal authority to enter into these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and these Terms apply to both you and the organization.
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.
3. PRODUCT TIERS
Pitstop offers free and paid product tiers.
Free features are provided on an as-is and as-available basis without service level commitments or guarantees.
Paid plans provide access to additional functionality as described at the time of purchase. Features, limits, and availability may vary by tier and may change over time.
4. FEES AND PAYMENT
Paid plans are billed in advance on an annual basis unless otherwise stated. All fees are non-refundable except where required by law. You authorize Pitstop to charge your selected payment method for all applicable fees.
Pitstop may suspend or terminate access for non-payment.
5. CUSTOMER CONTENT AND OWNERSHIP
You retain all right, title, and interest in and to any sales call recordings, transcripts, audio, text, or other materials you upload or submit through the Services ("Customer Content"). No ownership rights are transferred to Pitstop.
You grant Pitstop a non-exclusive, worldwide, royalty-free, sublicensable license to host, process, analyze, transcribe, and generate outputs from Customer Content solely to provide, operate, secure, and improve the Services.
All feedback, insights, benchmarks, scores, and recommendations generated by the Services ("Outputs") are derivative insights and do not contain reconstructable copies of your original recordings.
6. CONSENT AND LAWFUL RECORDING
You represent and warrant that you have obtained all necessary rights, notices, and consents from all participants to record, upload, and analyze any communications submitted to the Services, and that such actions comply with all applicable laws and regulations.
You are responsible for complying with all applicable recording consent laws, including obtaining consent from all call participants where required by law. Different jurisdictions have different requirements for recording consent (one-party vs. two-party consent states/countries). Pitstop is not responsible for verifying recording consent and disclaims all liability arising from unlawful recording or use of Customer Content.
7. ACCEPTABLE USE
You agree not to use the Services to:
- Violate any applicable law or regulation
- Infringe intellectual property, privacy, or confidentiality rights
- Upload unlawful, misleading, harmful, or offensive content
- Upload regulated or sensitive personal data
- Reverse engineer, resell, sublicense, or interfere with the Services
- Use the Services to compete with Pitstop or build a similar product
- Create hateful content targeting protected groups based on race, ethnicity, religion, disability, gender, age, or sexual orientation
- Engage in activities that mislead others
- Share pornographic or explicit content
Pitstop reserves the right to investigate and take appropriate action against anyone who violates these restrictions, including removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.
8. AI OUTPUTS AND LIMITATIONS
Outputs are generated based on patterns and probabilistic analysis. They may not be accurate, complete, or suitable for every situation.
You are solely responsible for decisions and actions taken based on Outputs. Human judgment and professional oversight remain essential.
8A. AI AVATARS AND PERSONAS
Avatars may include fully synthetic AI personas, AI personas trained on coaching methods and frameworks (with appropriate permissions), or custom personas configured by your organization. All avatars are automated systems that do not represent real individuals, provide licensed professional advice, or create personal coaching relationships.
You acknowledge that avatar responses are generated algorithmically and may not reflect real-world judgment, empathy, or situational awareness.
9. AI MODEL IMPROVEMENT AND DATA USE
Pitstop may use anonymized and aggregated data derived from Customer Content and Outputs to improve the performance and reliability of its AI systems. Such data will not reasonably identify you, your organization, or individual call participants.
Paid customers may request exclusion from AI model improvement by providing written notice to Pitstop, subject to technical feasibility.
10. ORGANIZATIONAL ACCOUNTS
Where an organization is the account holder, it may access performance data and coaching insights relating to its users, including:
- Individual execution scores, skill assessments, and improvement trends
- Team dashboards, leaderboards, and benchmarks
- Aggregated analytics and auto-generated coaching recommendations
Access to underlying call recordings depends on account configuration and organizational policies.
Users acknowledge that their employer or organization may administer their use of the Services and may monitor individual performance metrics and coaching engagement.
11. THIRD-PARTY SERVICES
The Services may rely on third-party technologies or integrations. Pitstop is not responsible for third-party services and disclaims liability arising from their operation or availability.
12. PRIVACY
Our Privacy Policy explains how we collect, use, and protect personal information. By using the Services, you agree to our Privacy Policy.
Coaching Data:
- Your conversations and performance data are processed to personalize coaching and improve service quality
- Do not share passwords, account credentials, confidential business details, or authentication data in coaching sessions
- Use discretion when discussing sensitive or confidential information
- Team administrators may access coaching conversations for quality assurance purposes
13. DISCLAIMERS
The Services and Outputs are provided on an as-is and as-available basis. To the fullest extent permitted by law, Pitstop disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement.
Professional Services
Pitstop does not provide legal, medical, financial, or other licensed professional advice. References to "coaching" within the Services describe an AI-assisted feedback experience and do not create a professional coaching, employment, or fiduciary relationship.
Emergency and Crisis Situations
The Services are not designed for crisis intervention or emergency situations. If you are experiencing a mental health crisis, suicidal ideation, or any other emergency, contact your local emergency services or a qualified mental health professional immediately.
AI Limitations
AI-generated Outputs are based on patterns and probabilistic analysis. They may not be accurate, complete, or suitable for every situation. AI systems may reflect biases present in training data and may not fully understand cultural contexts, individual nuances, or complex circumstances. Human judgment and professional oversight remain essential.
14. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Pitstop shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of revenue, profits, data, or business arising from your use of the Services.
15. INDEMNIFICATION
You agree to indemnify and hold harmless Pitstop and its affiliates from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
16. SUSPENSION AND TERMINATION
Pitstop may suspend or terminate access to the Services at its discretion for violation of these Terms, non-payment, or legal compliance reasons.
17. CHANGES TO THE SERVICES OR TERMS
Pitstop may modify the Services or these Terms from time to time. Continued use after changes take effect constitutes acceptance of the updated Terms.
