These Terms & Conditions ("Terms") govern your access to and use of the Pitstop platform, including our website, AI sales coaching tools, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

DEFINITIONS

The following definitions apply throughout these Terms:

  • "Customer Content": any sales call recordings, transcripts, audio, text, or other materials you upload or submit through the Services.
  • "Inputs": information you provide during coaching interactions, including text, goals, challenges, and performance data.
  • "Outputs": the coaching guidance, scores, insights, benchmarks, and recommendations generated by the Services based on your Inputs and Customer Content.
  • "Services": the Pitstop platform, including our website, AI coaching tools, and related features.

1. THE SERVICES

Pitstop provides an AI-powered revenue coaching system designed to analyze recorded sales conversations, identify execution breakdowns, deliver corrective coaching, and reinforce improvement call by call.

The Services are provided for informational and developmental purposes only. Pitstop does not guarantee sales outcomes, revenue performance, or deal success.

The Services may expand over time to include coaching for other business execution workflows.

2. ELIGIBILITY AND ACCOUNT USE

You must be at least 18 years old and have the legal authority to enter into these Terms. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and these Terms apply to both you and the organization.

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

3. PRODUCT TIERS

Pitstop offers three product tiers designed to meet teams at different stages of execution maturity.

Free

The Free tier provides access to core platform features at no charge, on an as-is and as-available basis, without service level commitments or uptime guarantees. Best suited for teams validating execution gaps before committing to a paid plan.

Core

The Core tier is a paid plan providing access to the full revenue coaching system, including post-call AI coaching, execution scoring, improvement tracking, and team analytics. Core is billed in advance on an annual basis unless otherwise stated. Best suited for teams ready to systemize execution and build compounding improvement over time.

Custom

The Custom tier is available to enterprise and larger organizations requiring tailored configuration, dedicated support, advanced integrations, or bespoke commercial terms. Pricing and scope are agreed contractually. Best suited for organizations seeking a durable, differentiated execution advantage at scale.

Features, limits, and availability may vary by tier and are subject to change. Pitstop reserves the right to modify tier inclusions with reasonable notice to affected customers.

4. FEES AND PAYMENT

Paid plans are billed in advance on an annual basis unless otherwise stated. All fees are non-refundable except where required by law. You authorize Pitstop to charge your selected payment method for all applicable fees.

Paid plans renew automatically at the end of each billing period unless cancelled in writing before the renewal date.

Pitstop may suspend or terminate access for non-payment.

5. CUSTOMER CONTENT AND OWNERSHIP

You retain all right, title, and interest in and to your Customer Content. No ownership rights are transferred to Pitstop.

You grant Pitstop a non-exclusive, worldwide, royalty-free, sublicensable license to host, process, analyze, transcribe, and generate Outputs from Customer Content solely to provide, operate, secure, and improve the Services.

All Outputs are derivative insights and do not contain reconstructable copies of your original recordings.

6. CONSENT AND LAWFUL RECORDING

You represent and warrant that you have obtained all necessary rights, notices, and consents from all participants to record, upload, and analyze any communications submitted to the Services, and that such actions comply with all applicable laws and regulations in the relevant jurisdiction.

Recording consent requirements vary by jurisdiction. One-party and two-party (all-party) consent rules differ across countries and US states. You are solely responsible for understanding and complying with the recording laws applicable to each call you submit to the Services. Pitstop is not responsible for verifying recording consent and disclaims all liability arising from unlawful recording or use of Customer Content.

To support your compliance obligations, Pitstop may from time to time provide general guidance or resources relating to recording consent. Any such guidance is informational only and does not constitute legal advice.

7. ACCEPTABLE USE

You agree not to use the Services to:

  • Violate any applicable law or regulation
  • Infringe intellectual property, privacy, or confidentiality rights
  • Upload unlawful, misleading, harmful, or offensive content
  • Upload regulated or sensitive personal data
  • Reverse engineer, resell, sublicense, or interfere with the Services
  • Use the Services to compete with Pitstop or build a similar product
  • Create hateful content targeting protected groups based on race, ethnicity, religion, disability, gender, age, or sexual orientation
  • Engage in activities that mislead others
  • Share pornographic or explicit content

Pitstop reserves the right to investigate and take appropriate action against anyone who violates these restrictions, including removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

8. AI OUTPUTS AND LIMITATIONS

Outputs are generated based on patterns and probabilistic analysis. They may not be accurate, complete, or suitable for every situation.

You are solely responsible for decisions and actions taken based on Outputs. Human judgment and professional oversight remain essential.

9. AI MODEL IMPROVEMENT AND DATA USE

Pitstop may use anonymized and aggregated data derived from Customer Content and Outputs to improve the performance and reliability of its AI systems. Such data will not reasonably identify you, your organization, or individual call participants.

Paid customers may request exclusion from AI model improvement by submitting a written request to support@takeapitstop.com. Pitstop will action all valid opt-out requests within 30 days of receipt. Exclusion applies to data processed after the opt-out takes effect and does not require deletion of previously aggregated or anonymized data.

10. ORGANIZATIONAL ACCOUNTS

Where an organization is the account holder, it may access performance data and coaching insights relating to its users, including:

  • Individual execution scores, skill assessments, and improvement trends
  • Team dashboards, leaderboards, and benchmarks
  • Aggregated analytics and auto-generated coaching recommendations

Access to underlying call recordings depends on account configuration and organizational policies.

Users acknowledge that their employer or organization may administer their use of the Services and may monitor individual performance metrics and coaching engagement.

11. THIRD-PARTY SERVICES

The Services may rely on third-party technologies or integrations. Pitstop is not responsible for third-party services and disclaims liability arising from their operation or availability.

12. PRIVACY

Our Privacy Policy explains how we collect, use, and protect personal information. By using the Services, you agree to our Privacy Policy.

Conversations and performance data submitted through the Services are processed to deliver personalized coaching, generate execution insights, and improve service quality. Team administrators may access coaching conversations and individual performance data for quality assurance and management purposes, in accordance with Section 10.

You must not submit Customer Content that includes data whose processing would breach applicable data protection legislation, including but not limited to special category personal data as defined under the UK GDPR and EU GDPR. You are responsible for ensuring that any personal data contained within Customer Content is handled in accordance with your own data protection obligations.

13. DISCLAIMERS

The Services and Outputs are provided on an as-is and as-available basis. To the fullest extent permitted by law, Pitstop disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement.

Professional Services

Pitstop does not provide legal, medical, financial, or other licensed professional advice. References to "coaching" within the Services describe an AI-assisted feedback experience and do not create a professional coaching, employment, or fiduciary relationship.

AI Limitations

AI-generated Outputs are based on patterns and probabilistic analysis. They may not be accurate, complete, or suitable for every situation. AI systems may reflect biases present in training data and may not fully understand cultural contexts, individual nuances, or complex circumstances. Human judgment and professional oversight remain essential.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Pitstop shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of revenue, profits, data, or business arising from your use of the Services.

15. INDEMNIFICATION

You agree to indemnify and hold harmless Pitstop and its affiliates from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

16. SUSPENSION AND TERMINATION

Pitstop may suspend or terminate access to the Services at its discretion for violation of these Terms, non-payment, or legal compliance reasons.

17. CHANGES TO THE SERVICES OR TERMS

Pitstop may modify the Services or these Terms from time to time. Continued use after changes take effect constitutes acceptance of the updated Terms.
