‍Welcome to Pitstop ("Pitstop", "we", "us", "our"), a service provided by PitstopHealth LTD, located at 19 Elgin Road, Ballsbridge, Dublin D04T2P6, Ireland. These Terms of Service govern your use of the Pitstop mobile application and related services (collectively, "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

‍Pitstop offers a range of wellbeing services, including content in audio and reading formats, habit and quick win tracking, life assessment tools, and community support features. Our Services are designed to help you improve your wellbeing across various aspects of life.

‍3. User Accounts and Registration
- Creating an Account: To use Pitstop, you must register and create an account, providing accurate and complete information.
- Eligibility: You must be at least 13 years old to use Pitstop. Users under the age of 18 require parental or guardian consent.
- Account Security: You are responsible for maintaining the confidentiality of your account information and for all activities under your account.

‍4. Subscriptions and Payments
- Subscription Types: Pitstop offers monthly and yearly subscriptions, with the latter including a 7-day free trial.
- Auto-Renewal and Cancellation: Subscriptions automatically renew unless canceled at least 24 hours before the renewal date. Cancellations can be made through Google Play or the Apple Appstore.
- Payment Processing: We process payments through third-party services. Your payment information is handled in accordance with our Privacy Policy.

‍5. User Data and Privacy
- Data Collection: We collect personal data such as your name, date of birth, and activity data in the app.
- Use of Data: Your data is used to personalize and improve your experience with our Services.

- Ownership of Content: All content provided through Pitstop, except user-generated content, is owned by us or our licensors.

‍You agree not to misuse the Services or help anyone do so. You must not attempt to harm our system integrity or security or decipher any transmissions to or from the servers running the Services.

- No Medical Advice: Pitstop is not a medical service and does not provide medical advice.
- Liability: To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

‍We reserve the right to modify these Terms at any time. We will provide notice of any material changes to these Terms by posting them on the Services.

‍10. Dispute Resolution
- Governing Law: These Terms are governed by the laws of Ireland.
- Dispute Resolution: Any disputes arising from these Terms will be resolved through final and binding arbitration, except as otherwise stated in these Terms.

‍11. Payment Methods, Reimbursement, and Retention Rights
- Payment Method: Payments are processed exclusively through Google Play Store and Apple Appstore.
- Refund Policy: All purchases are final. We do not issue refunds except as required by law. For refunds, please contact the respective App Store.
- Subscription Renewal: Your subscription is subject to automatic renewal. You can cancel it according to the App Store's policies.

- Limitation of Liability: We are not liable for: Any failure related to the internet, technical or IT means. Loss, contamination, or alteration of your data during or after using our Services. Unauthorized use of your account or login credentials. Improper or illegal use of your account or the Services. Violations of these Terms by you or third parties. Force majeure events.
- Damage Cap: Our total liability for proven direct damages is limited to the amount you paid us over the last twelve months for the Services concerned, except in cases of fraud or willful misconduct. We are not liable for indirect, special, incidental, consequential, exemplary, or punitive damages.
- Time Limit for Claims: Any claims arising from these Terms must be brought within one year of gaining knowledge of the cause of action.
